Swimming Pool Enclosure Permit
All swimming pools and hot tubs within the Town of Newmarket that can hold 0.6 metres (two feet) of water will require an enclosure – the installation of required fencing around the pool/hot tub. A Swimming Pool Enclosure Permit must be obtained prior to the construction of the pool and must comply with the Town's Pool Enclosure By-law 2008-18.
Swimming Pool Enclosure Permit Process
In order to obtain a Swimming Pool Enclosure Permit, the following documents must be provided to the Legislative Services department at the Municipal Offices. Different documents are required depending on the type of pool you are installing, and if access to Town property is required. See below for more details:
In ground Pools, on ground pools and/or Machinery going over Town Blvd (Assumed Roads)- Completed Swimming Pool Enclosure Permit Application Form
- Two copies of the property site plan showing the proposed location of the swimming pool and equipment in relation to property lines, buildings, and easements (these may be hand drawn)
- Completed Undertaking and Indemnification Form
- Payment for the Pool Permit Fee, Boulevard Inspection Fee, and Deposit as prescribed in the Town's Fees By-law.
- Once an application is received, The Town will provide more information on payment details. All fees can be paid for over the phone, with the exception of the deposit which can be paid by cheque, bank draft or a money order.
- Road Occupancy Permit (Obtained through Operations Department)
If access through Town Property is required, please follow these steps:
- Complete the Permission to Enter (PTE) Application Form to our Legal Department
- Email the application to [email protected]. You can also drop off the application in person or send it by mail.
- Payment for a non-refundable deposit fee of $250. Once an application is received, the Town will provide information on payment details.
All Pools or Hot Tub on an Unassumed Road - Completed Swimming Pool Enclosure Permit Application Form
- Two copies of the property site plan showing the proposed location of the swimming pool and equipment in relation to property lines, buildings, and easements (these may be hand drawn)
- Payment for the Pool Permit Fee as prescribed in the Town's Fees By-law.
- You can pay by calling 905-895-5193 or submit a cheque with your application in-peron or by mail.
- Completed and signed Clearance Letter from Engineering Services. Please email [email protected] for details
