Town-Initiated Official Plan and Zoning By-law Amendments
From time to time the Town will initiate amendments to the Official Plan and the Zoning By-laws. When these occur they will follow the notice provisions as required by the Town's Notice Policy and the Planning Act.
Some past Town-initiated Official Plan amendments have included Amendment #10 Secondary Plan and Amendment #11 Active Transportation Network.

Established Neighbourhood Compatibility Study
As the Town of Newmarket continues to grow, we are trying to keep the character of your neighbourhood.
In the past, some neighbourhoods have seen older homes replaced with newer homes, and there may be times where the home does not seem to fit with the overall character of the neighbourhood.
As a result, the Town had taken a closer look at all established neighbourhoods in Newmarket in order to identify and characterize them. On December 14, 2020, Council approved OPA 29 and Zoning By-law 2020-63, which implement the recommendations from the Established Neighbourhood Study. Both OPA 29 and By-law 2020-63 are in full force and effect.

Commercial Rooftop Patios
This is a Town-initiated Zoning By-law amendment, with the electronic public meeting scheduled for Monday, December 14, 2020 at 1 p.m.
By way of an electronic meeting using video conferencing (Zoom) to consider the recommended revisions to the current zoning regulations to permit commercial rooftop patios within the Town.
The purpose of these amendments is to propose zoning changes to permit commercial rooftop patios within the Town.
The Town is considering amendments to the comprehensive zoning by-law that would permit commercial rooftop patios in conjunction with restaurants, banquet halls and other commercial uses, subject to licensing and other requirements listed below. The draft regulations are:
“Restaurants, banquet halls, and other commercial uses shall be permitted to include a commercial rooftop patio as an accessory use, provided that the commercial rooftop patio complies with the following:
- A commercial rooftop patio is prohibited in association with an adult entertainment parlour;
- The design shall be established in accordance with an approved site plan addressing matters such as lighting, landscaping, noise, etc.
- A commercial rooftop patio must comply with any applicable requirements of municipal by-laws, including the Town’s licensing and noise by-laws, and must comply with all applicable requirements of the Ontario Building Code.”
There is no map as the proposed change applies to all of Newmarket.

Written comments will also continue to be received after the public meeting has concluded, after the meeting send written comments to

Speak to Council during the live meeting through video conferencing (Zoom)
Individuals who wish to provide verbal representation may provide a remote (live) deputation through the Zoom platform during the Council meeting. Due to the technical requirements of joining an electronic meeting, residents are strongly encouraged to pre-register for a remote (live) deputation by providing their full name and contact information and registering via

Personal information collected in response to these planning applications will be used to assist Town staff and Council to process these applications and will be made public.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Newmarket to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council of the Town of Newmarket before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council of the Town of Newmarket before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
